When buying a plot of land it is always recommended that a solicitor
is used. Your solicitor will
conduct a range of searches to ensure you are fully aware of what
you are buying. A task that is best done by the purchaser is to
visit the local planning department to identify the use
class for the plot of land.
The planning department of local authorities are usually open
during office hours to make precursory
enquiries about your plot of land. This may provide
information about previous uses - view older maps of the area to
help confirm this.
Research at this stage will also reveal the current
designation of the land. Residential land is sometimes referred
to as pink land. If it is not designated as residential, the planning
officer may be able to offer guidance by indicating whether it
might be considered as such in the future.
Most local authorities
have a 'development
plan' which clearly sets out what the land is designated for,
and this should be scrutinised for any evidence or proposals regarding
your particular plot.
If a change of use is required it is best to obtain the guidance
and advice of professional planning consultants. Planning consultants
have the experience and knowledge to
give an honest opinion of achieving a change of use class and the
level of risk involved. This information from the
outset will save time and money from pursuing a change of use
that is very unlikely.
Use classes had a reputation for not being
flexible but, increasing demand for new housing has meant that
the authorities are more willing to consider a change.
